Terms of Service

These Terms govern access to and use of the Fama Unchained website and platform. For clients, the signed services agreement prevails.

The Fama Unchained website (famaunchained.com) and platform (together, the “Service”) are operated by LAYER4, a French SARL (société à responsabilité limitée) with share capital of €500, registered with the RCS Versailles 799 738 612 (SIRET 799 738 612 00024), with its registered office at 3 B rue Exelmans, 78000 Versailles, France (“Fama Unchained”, “we”, “us”). By accessing the Service you agree to these Terms.

1. These Terms and your services agreement

Fama Unchained is a business service: each client engagement is governed by a written services agreement signed with LAYER4, which defines the scope of work, the accounts and platforms covered, fees, and any specific commitments. Where that agreement and these Terms differ, the signed agreement prevails. These Terms fill the gaps and govern use of the website by visitors.

2. Eligibility

The Service is intended for businesses and professionals. By using it on behalf of a company, you represent that you are authorised to bind that company, and that you are at least 18 years old.

3. The Service

Fama Unchained manages professional social-media presence — for example LinkedIn, dev.to and Medium — on accounts owned by the client, under an explicit, revocable authorisation. Content prepared through the Service goes through the review and approval workflow agreed with the client before anything is published under the client’s name. We grant you a limited, non-exclusive, non-transferable right to use the platform for your internal business purposes, subject to these Terms and your agreement.

4. Connected third-party platforms

  • You own, or are duly authorised to operate, every account you connect.
  • Your use of each platform remains subject to that platform’s own terms and policies; you are responsible for complying with them.
  • Authorisations you grant (for example via OAuth) are limited to the permissions requested and can be revoked at any time, from the Service or from the platform itself.
  • Platforms may change or restrict their APIs at any time; we are not responsible for such changes, though we will use reasonable efforts to adapt.

5. Your obligations

  • You hold the necessary rights to the materials, marks and factual claims you provide for use in your content.
  • You review content submitted for approval with reasonable care; what you approve is published under your name.
  • You keep your account credentials confidential and current.

6. Acceptable use

You must not use the Service to:

  • violate any law, regulation, or third-party right;
  • publish unlawful, deceptive, defamatory or infringing content;
  • circumvent a platform’s rules, rate limits or security measures;
  • probe, disrupt or reverse-engineer the Service.

7. Your content

You retain all rights to the content, brand assets and data you provide. You grant LAYER4 the licence needed to host, process and publish that content on your behalf, for the sole purpose of providing the Service, for the duration of the engagement.

8. Our intellectual property

The Service, its software, design and documentation are and remain the property of LAYER4 or its licensors. No rights are granted except as expressly set out in these Terms or your agreement.

9. Fees

Fees, invoicing and payment terms are defined in your services agreement. The public website is free to browse.

10. No affiliation

Fama Unchained is not affiliated with, endorsed by or sponsored by LinkedIn, Medium, dev.to, Meta or any other platform. All trademarks belong to their respective owners.

11. Disclaimers

The Service is provided with reasonable skill and care. To the extent permitted by law, it is otherwise provided “as is”: we do not warrant uninterrupted availability, nor any particular audience, reach or business outcome.

12. Limitation of liability

Unless your services agreement provides otherwise, and except for liability that cannot be limited under applicable law, LAYER4’s total aggregate liability under these Terms is limited to the fees paid for the Service in the twelve months preceding the event giving rise to the claim, and neither party is liable for indirect or consequential loss.

13. Suspension and termination

We may suspend or terminate access in case of material breach of these Terms. Termination of a client engagement is governed by the services agreement. Upon termination, the authorisations you granted are revoked and we cease publishing on your behalf.

14. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date above reflects the latest version; material changes will be notified to active clients.

15. Governing law and jurisdiction

These Terms are governed by the laws of France. Any dispute not resolved amicably shall be submitted to the competent courts of Versailles, France, subject to any mandatory rules to the contrary.
